OET (The Occupational English Test) is a high-stakes English Language proficiency test designed and accredited to assess the communication skills required for healthcare professionals seeking to register, work or study in an English-speaking environment. To meet Recognising Organisations requirements, candidates are required to attain a minimum score for each of the measured sub-tests (Listening, Reading, Writing, Speaking).
OET&rsquo;s Education team emphasises the importance of becoming familiar with both the test construct and the assessment criteria and offers a variety of preparation materials for both non-native and native speakers of English.
To best prepare candidates, OET provides&nbsp;support on its website to facilitate test preparation, including the details of endorsed OET Preparation Course Providers.

1. Introduction

The OET Test Regulations apply to all modes of test delivery, as follows:
<ul>
<li>OET&nbsp;on Paper at a test venue;</li>
<li>OET on Computer&nbsp;at a test venue; and</li>
<li>OET@Home.</li>
</ul>
The OET Test Regulations are designed to ensure:
<ul>
<li>OET&nbsp;candidates are treated fair and equitably;</li>
<li>the testing environment is secure; and</li>
<li>that all staff conform to high-quality performance standards.</li>
</ul>

2. Purpose

Acceptable/Valid ID: identification (ID) that meets and complies with the OET Acceptable Candidate Identification Policy in section 4.6 of the Test Regulations.
Book: has the same meaning as Booking in these Test Regulations.
Booking:&nbsp;completed booking&nbsp;using OET&rsquo;s&nbsp;booking&nbsp;portal to take the OET&nbsp;on&nbsp;a&nbsp;scheduled test day/time.
Business day: a business day for the purpose of this document is Monday to Friday, 9:00am to 5:00pm in Melbourne, Australia. Business Days do not include local public holidays.
Candidate: someone who has&nbsp;booked OET using OET&rsquo;s&nbsp;booking&nbsp;portal.
CBLA:&nbsp;Cambridge&nbsp;Boxhill&nbsp;Language Assessment&nbsp;Pty Ltd as trustee for Cambridge&nbsp;Boxhill&nbsp;Language Assessment Unit Trust&nbsp;(the&nbsp;owner of OET) and formally recognised as OET.
Clubbing:&nbsp;using two or more test results that have been issued against different OET test dates to achieve the required score set by a Recognising Organisation.
OET&nbsp;or test modes:&nbsp;Occupational English Test&nbsp;(OET), which includes OET&nbsp;on Paper,&nbsp;OET on Computer at a test venue,&nbsp;OET@Home,&nbsp;and&nbsp;OET&nbsp;Speaking Test&nbsp;Online&nbsp;(where applicable). Consists of four sub-tests: Listening, Reading, Writing + Speaking (LRW+S).
OET:&nbsp;for the purpose of these Test Regulations, OET also refers to the entity that administers the Occupational English Test, and may be used interchangeably with CBLA.
OET Account:&nbsp;self-access portal for OET on Computer where a candidate can log in to view and manage bookings,&nbsp;view&nbsp;results and&nbsp;allow access for&nbsp;Recognising&nbsp;Organisations&nbsp;to verify results.
OET&nbsp;Speaking Test&nbsp;Online:&nbsp;the Speaking sub-test delivered via Zoom&nbsp;required to be taken with OET&nbsp;on Computer.
myOET:&nbsp;online account dashboard for candidates who have booked OET on Paper. Allows candidates to book and manage bookings, check or print Statements of Results, and perform other account management functions.
Proctor:&nbsp;Invigilator who oversees&nbsp;OET@Home&nbsp;test administration on test day.
Prometric&trade;:&nbsp;OET&rsquo;s delivery partner for computer-based testing.&nbsp;The computer-based test delivery system is offered through our third-party delivery partner Prometric.
Sub-test:&nbsp;Any individual test component of the OET. Listening, Reading, Writing and Speaking (LRWS)&nbsp;are sub-tests of the OET.
Recognising Organisation:&nbsp;An external organisation that accepts OET results as proof of a Candidate&rsquo;s English language proficiency, such as a healthcare regulator or University, a full list of all Recognising Organisations can be found on our&nbsp;<a href="https://oet.com/discover/who-recognises-oet">website</a>.
Special Arrangements/Testing Accommodations: any adjustments or arrangements requested by a candidate to ensure they are provided with a fair and equitable opportunity to take the OET.
Test Administrator:&nbsp;Senior Invigilator or Proctor who oversees test administration on test day.
Test Administration:&nbsp;time period during which all four sub-tests are offered or administered.
Venue Manager: the main point of contact at a&nbsp;Venue.
Venue: an authorised venue where a candidate takes either OET on Paper or OET on Computer.

4. Pre-test information

Taking OET requires uninterrupted access to the internet, power supply, websites, devices or services that are not owned or controlled by OET. OET has no control over and assumes no responsibility for such access, devices or services.
When booking the OET, you must acknowledge and agree that OET will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such access, devices or services.
OET and any other party involved in creating, producing or delivering the test are not liable for any direct, incidental, indirect, consequential, special, punitive or similar damages arising out of access to, use of, acceptance by or interpretation of the results by any third party, or any errors or omissions in the content of OET.
OET&rsquo;s maximum liability is limited to, at our election, re-supplying OET or refunding the test fee.

6. Test Day Information

7.1&nbsp;Results
Results are issued online approximately 12 business days after the test. A score ranging from 0&ndash;500 is issued for each sub-test. An overall grade for OET is not issued. In the event of a technology malfunction where we are unable to issue results online, we will email results directly to candidates.
From time-to-time OET is unable to release results in the timeframe stated.&nbsp;If circumstances beyond OET&rsquo;s control prevent us from publishing your results after you take the test (for example, where technical issues prevent us from being able to complete assessment activities), you will be allowed to select a future scheduled test date with no test administration fee or application fee charged.
You must check in on your OET test day. If you fail to check-in and attempt any of the four subtests, you will be marked as absent for the relevant subtest(s). You will receive a score of zero, and this will appear as a blank on your Statement of Results. If you fail to appear for all four sub-tests, you cannot receive a score and a Statement of Results.
Your results will be withheld if your test is subject to malpractice analysis (please refer to section 10 for further details).
OET may withhold results in some instances due to rescheduled tests, malpractice, ID documentation discrepancies, and technical issues.&nbsp;In these circumstances OET will notify you via email. You are required to respond and submit additional documents in accordance with the timeframe specified in the notification, if you do not respond within the timeframe provided your results may be withheld permanently.

7. Post Test Day Information

The&nbsp;<a href="https://oet.com/remarking-policy">OET Re-marking Policy</a>&nbsp;aims to ensure that candidates (you) can request a re-mark of one or more sub-tests if you believe that your results do not reflect your true performance on the test. OET aim to ensure that such requests are received, reviewed and resolved fairly and transparently.

8.1 What does re-marking involve?&nbsp;
To have your subtest(s) remarked, you must pay a fee of AU$120/US$95 per sub-test to complete your re-marking request.
You will receive the outcome of your remarking request 3-6 weeks from the day you submit the request. If there is a grade change, the remarking fee will be reimbursed however, if the outcome of your remarking does not change your grade, you will not be refunded this fee.

8.2 When can I request a re-mark of my sub-test?&nbsp;
You can request for re-marking within&nbsp;72 hours&nbsp;from when your results are released. Requests received after this period will not be accepted.
Remarking requests will only be reviewed if the payment has been made. Any request submitted without payment will not be assessed.
If your request for remarking was submitted for the wrong sub-test, please contact OET no later than&nbsp;72 hours&nbsp;from the submission. Once remarking is initiated it can not be reversed and you will not be refunded the remarking fee.

8.3 How can I request re-marking?&nbsp;&nbsp;
OET on Paper at a venue candidates:&nbsp;must log in to&nbsp;<a href="https://registration.myoet.com/">myOET</a>&nbsp;and click the &ldquo;Request Re-marking&rdquo; link for the sub-test or tests you want to get remarked.
OET on Computer at a venue and&nbsp;OET@Home&nbsp;candidates:&nbsp;must complete the&nbsp;<a href="https://oet.formstack.com/forms/remarking_form_cbt_copy_1">Computer Based Testing Remarking Form</a>.

8.4 Re-marking outcomes&nbsp;
Re-marking outcomes can include:
<ul>
<li>increased scores;</li>
<li>decreased scores; or</li>
<li>no change to your score.</li>
</ul>
Your&nbsp;<a href="https://registration.myoet.com/">myOET</a>&nbsp;Dashboard or&nbsp;<a href="https://oet-global.com/">OET Account</a>&nbsp;will be updated with your new result(s).
Note:&nbsp;on myOET, your updated Statement of Results will be available for download within 24 hours with your new result(s).
Where the outcome of a re-marking request brings into question the accuracy of grades awarded in an assessment, OET will take all reasonable steps to identify any other candidate who may have been affected and, wherever possible correct or mitigate the error.

8.5 Important Information for Candidates&nbsp;
<ul>
<li>The re-marking process does not provide qualitative feedback on your performance.</li>
<li>If you take another test (OET or from any other provider) during the time OET is carrying out the re-marking, OET will not refund any costs related to you taking that test, even if the re-marking increases your grade.</li>
<li>If you change your mind before re-marking outcomes are published, you can request the re-marking outcome not be published. No refund will be provided in this circumstance.</li>
<li>A re-marked result cannot be reversed back to the original result on the candidate&rsquo;s request once it has been published. Your Statement of Result will&nbsp;only&nbsp;display the remarking score.</li>
<li>Requests for re-marking will only be accepted from candidates personally. A request made by a third party, relative, friend or colleague will not be accepted.</li>
</ul>

8.6 Can I appeal the outcome of the re-marking?&nbsp;
<ul>
<li>Any appeal against the outcome of the re-marking process must follow&nbsp;Section 13. OET Appeals Policy and Process.</li>
<li>You can appeal the outcome of the re-marking if you believe the re-marking decision was not arrived at properly and fairly.</li>
<li>You cannot appeal unless the re-marking process has been completed.</li>
<li>Re-marking and appeal charges will be refunded in full if your sub-test grade(s) change as a result of your appeal.</li>
<li>There is an  (OET on Paper) US$95 (OET on Computer) fee for the submission of each stage of an appeal (per subtest): Stage 1 and Stage 2. For more information, please see Section 13 OET Appeals Policy.</li>
</ul>

8. Re-marking 

9.1 Rescheduling OET&nbsp;
This section applies to all OET delivery modes, including OET on Paper at a test venue, OET on Computer at a test venue and&nbsp;OET@Home.

Important information for candidates:
<ul>
<li>If you have booked OET but cannot attend the original booked test date, you can reschedule&nbsp;to another available date, subject to the conditions and fees listed in the table below.</li>
<li>If you have a special arrangement/testing accommodation in your original booking, you will need to resubmit the supporting documents as part of the rescheduling</li>
<li>Rescheduling may include a change of venue and/or test date to&nbsp;another&nbsp;available test administration. It can also include a change to delivery mode.</li>
<li>You cannot change the profession for which you have booked OET. Refer to&nbsp;Section 9.2 Cancelling OET&nbsp;for further information.</li>
<li>You may reschedule at any time, up to and including the day of the test, subject to a rescheduling fee.</li>
<li>Before booking closing date, you can reschedule your test to any available test date, including within the same test administration window. If bookings have closed, you must reschedule to a future open test administration window. All bookings are subject to availability.</li>
<li>A rescheduled booking cannot be reversed.</li>
<li>Your Speaking rescheduling can only be made once.</li>
</ul>

Pre-test (before booking closing date):

<li>You can reschedule in&nbsp;<a href="https://registration.myoet.com/" target="_self">myOET</a>&nbsp;up to the&nbsp;<a href="https://oet.com/test/book-a-test">booking closing date</a>&nbsp;for a fee of AU$120.</li>
<li>You can reschedule to a future test date or to another location or country for the same test date.</li>
</ul>
Pre-test day (after bookings close and before test date):
<ul>
<li>You can reschedule in&nbsp;<a href="https://registration.myoet.com/" target="_self">myOET</a>&nbsp;after the&nbsp;<a href="https://oet.com/test/book-a-test">booking closing date</a>&nbsp;and until the day before the test for a fee of AU$200.</li>
<li>You can only reschedule to a future test date administration which can include change of day and/or location/country.</li>
</ul>
On test day:
<ul>
<li>You can contact Customer Service via&nbsp;<a href="https://support.occupationalenglishtest.org/">OET Support</a>&nbsp;up to two calendar days after the test date to request a reschedule, your case will be reviewed and assessed accordingly.</li>
<li>You can only reschedule to a future test date administration which can include change of day and/or location/country.</li>
<li>If you need a late reschedule and you have not attempted any subtests, you must fill in the&nbsp;<a href="https://oet.formstack.com/forms/deferral_after_application_closing_date_row">test day rescheduling form&nbsp;</a>and pay a fee of AU$200.</li>
</ul>
Change of delivery mode
If you require a change of delivery method from OET on Paper at a test venue to OET on Computer at a test venue or&nbsp;OET@Home&nbsp;(subject to availability), you will need to:
<ul>
<li>Cancel your booking in&nbsp;<a href="https://registration.myoet.com/" target="_self">myOET</a>&nbsp;You will receive a partial refund back into the card used for making the initial payment (please refer to the table below for the applicable fees); and</li>
<li>Book and pay directly on the&nbsp;<a href="https://oet-global.com/">OET Account</a>&nbsp;for the new delivery mode and test date.</li>
</ul>
Note:&nbsp;If you are unable to make the cancellation directly on&nbsp;<a href="https://registration.myoet.com/" target="_self">myOET</a>, please contact Customer Service via&nbsp;<a href="https://support.occupationalenglishtest.org/">OET Support</a>&nbsp;so they can provide you support on this.
Due to limited seats for OET on Computer at a test venue or&nbsp;OET@Home, it is recommended that you check availability before cancelling your original test.&nbsp;


OET on Computer at a test venue: Listening, Reading, and Writing (LRW) and/or Speaking sub-tests
&nbsp;Pre-test (before booking closing date):
<ul>
<li>You can reschedule all four sub-tests (LRWS) up to&nbsp;7 calendar days before your LRW date for a fee of US$95. Subject to availability.</li>
<li>You can just reschedule your Speaking sub-test within the same test administration for a fee of US$25.</li>
</ul>
Pre-test day (after booking closing date and before test date):
<ul>
<li>You can reschedule all four sub-tests (LRWS) up to&nbsp;48 hours before your LRW start time or your Speaking time, whichever is the soonest, to another available test administration for a fee of US$155. Subject to availability.</li>
<li>You can just reschedule your Speaking sub-test up to&nbsp;48 hours before your LRW start time or your Speaking time for a fee of US$80. Subject to availability.</li>
<li>You cannot reschedule if the date of your first sub-test has passed.</li>
</ul>
Late Reschedule (Within 48 hours of either your scheduled LRW time or Speaking time):
<ul>
<li>If you need a late reschedule and you have not attempted any subtests, you must fill in the&nbsp;<a href="https://oet.formstack.com/forms/untitled_form_16">test day rescheduling form</a> and pay an US$155 fee.</li>
<li>If you fail to attend your Speaking sub-test, you must contact&nbsp;<a href="https://support.occupationalenglishtest.org/">OET Support</a> as soon as possible and no later than 24 hours after your speaking scheduled test start time in order to reschedule. A fee of US$80 will be applied. Failure to reschedule your Speaking sub-test will result in a Speaking score of zero, which will be displayed as a blank in your Statement of Results. Rescheduling can only be made once.</li>
</ul>

Change of country for OET on Computer at a venue and&nbsp;OET@Home
If you require a change of country for the same delivery method to any other country, then you will need to:
<ul>
<li>Cancel your booking in the OET Account directly and rebook your new preferred OET location. Rescheduling fees will be applied which will be deducted from your refund amount. Refer to the&nbsp;Rescheduling Fees Table.</li>
</ul>

OET@Home: Listening, Reading, and Writing (LRW) and/or Speaking sub-tests
Pre-test (before booking closing date):
<ul>
<li>You can reschedule all four sub-tests (LRWS) up to&nbsp;7 calendar days before your LRW date for a fee of US$95. Subject to availability.</li>
<li>You can just reschedule your Speaking sub test within the same test administration for a fee of US$25.</li>
</ul>
Pre-test day (after booking closing date and before test date):
<ul>
<li>You can reschedule all four sub-tests (LRWS) up to&nbsp;48 hours before your LRW start time or your Speaking time, whichever is the soonest, to another available test administration for a fee of US$155. Subject to availability.</li>
<li>You can just reschedule your Speaking sub-test up to&nbsp;48 hours before your LRW start time or your Speaking time for a fee of US$80. Subject to availability.</li>
<li>You cannot reschedule if the date of your first sub-test has passed.</li>
</ul>
Late Reschedule (Within 48 hours of either your scheduled LRW time or Speaking time):
<ul>
<li>If you need a late reschedule and you have not attempted any subtests, you must fill in the&nbsp;<a href="https://oet.formstack.com/forms/untitled_form_16">test day rescheduling form</a> and pay an US$155 fee.</li>

Change of delivery mode
If you require a change of delivery mode and there is an alternative mode available in your country, then you will need to:
<ul>
<li>Contact&nbsp;<a href="https://support.occupationalenglishtest.org/">OET Support</a>&nbsp;and make payment for the request to be processed.</li>
<li>Once the form and payment are submitted, you will receive a confirmation of booking no later than five business days.</li>
</ul>

9.2 Cancelling OET&nbsp;
This applies to all OET delivery modes including:
<ul>
<li>OET on Paper at a test venue;</li>
<li>OET on Computer at a test venue; and</li>
<li>OET@Home.</li>
</ul>
If you wish to cancel the OET after booking your test, you will be refunded depending on when your cancellation request is made.
Note:&nbsp;You must cancel your whole booking and cancellations cannot be reversed.
&nbsp;
OET on Computer at a test venue and&nbsp;OET@HOME
<ul>
<li>You cannot cancel if you have completed one of the sub-tests of that test administration.</li>
<li>You can cancel before your LRW booking closing date (in your local time zone) and receive a refund of US$355. You can do this directly in the <a href="https://oet-global.com/">OET Account.</a></li>
<li>You can cancel after the booking closing and up&nbsp;48 hours before your test start time (in your local time zone) and receive a refund of US$295</li>
<li>You cannot request a refund after your test.</li>

OET on Paper at a test venue
<ul>
<li>You can request a cancellation for the sub-tests you have booked as long as it is within the cancellation timeline (below). For more information refer to&nbsp;<a href="https://support.occupationalenglishtest.org/hc/en-gb/articles/115005414925-How-do-I-withdraw-">How to Withdraw</a>&nbsp;on the OET website.</li>
<li>You can cancel up to&nbsp;one week&nbsp;before the test day, subject to conditions and fees listed in below table.</li>
<li>If your test is on a&nbsp;Friday, refunds will not be provided for any cancellation made after 11.59PM (local time) the&nbsp;Saturday before the test.</li>
<li>If your test is on a&nbsp;Saturday, refunds will not be provided for any cancellation made after 11.59PM (local time) the&nbsp;Sunday before the test.</li>
<li>You cannot request a partial cancellation, for example, if you have booked two sub-tests, you must cancel both.</li>
<li>You may receive a refund after the booking closing date.</li>

Unforeseen circumstances&nbsp;
If for unforeseen circumstances outside our control, we are unable to deliver your test or we are unable to release your results after your test has been completed (e.g., due to technical reasons at our end, including failure to verify your identity due to technical issues), you will be entitled to re-book/reschedule to another test date at no additional cost.&nbsp; If there are no suitable dates, then a full refund will be issued.
Please note that OET will not refund travel,&nbsp;accommodation,&nbsp;or any other costs.

Test Cancellation Disclaimer
OET will take all reasonable steps to ensure it fulfils its agreement to provide its services in accordance with this Policy. However, OET will not be liable for any consequences that may arise in the unforeseen event that a test is cancelled.

9. Rescheduling and Cancellation

The OET Malpractice Policy aims to provide a transparent and ethical process for the management of candidate actions/conduct (malpractice).
OET is committed to preventing the occurrence of fraud and maintaining the security and integrity of the OET.

10.1&nbsp;Types of Malpractice&nbsp;
Malpractice is any action which seeks an unfair advantage in relation to OET.
Malpractice includes, but is not limited to, the following:
<ul>
<li>obtaining unauthorised access to examination material;</li>
<li>attempting to obtain an unfair advantage (cheating or deception) in any way, including using or trying to use unauthorised material;</li>
<li>copying/collusion or attempted copying/collusion with others;</li>
<li>disruptive behaviour or not following the instructions of test administrators including the use of prohibited devices;</li>
<li>impersonation (pretending to be someone else);</li>
<li>reproducing any part of the OET test in any medium including memorising test material to gain or give an unfair advantage;</li>
<li>altering any results document, including Statement of Results in any medium; and</li>
<li>any other form of cheating or gaining of an unfair advantage.</li>
</ul>
OET will received reports of suspected malpractice by the following, including:
<ul>
<li>the venue or test administrator;</li>
<li>by an OET Assessor;</li>
<li>by a Proctor;</li>
<li>routine statistical analysis of candidates&rsquo; answers;</li>
<li>following a review and/or investigation of candidates&rsquo; test responses;</li>
<li>members of the public via the&nbsp;<a href="https://www.occupationalenglishtest.org/reporting-suspected-fraud-or-suspicious-activity/">OET Reporting Suspected Fraud or Suspicious Activity Report form</a>; and</li>
<li>other means utilised by OET from time to time.</li>
</ul>

10.2&nbsp;Reporting Suspected Fraud or Suspicious Activity&nbsp;
OET welcomes legitimate reports of the following reportable matters:
<ul>
<li>suspected fraud, malpractice, misconduct or other suspicious activity in respect of OET; and</li>
<li>threats to the security or integrity of OET.</li>
</ul>
If you believe you have witnessed, suspect or are aware of any reportable matters, OET invites you to report the matter.
You can raise a concern with OET under the arrangements outlined in this policy if you have reasonable belief that malpractice and/or a wrongdoing is occurring or is likely to occur.
To support OET investigations on malpractice/fraud you&nbsp;may need to provide OET with additional information&nbsp;following your report of suspected fraud or suspicious activity.
To contact OET with information concerning a reportable matter you can email <a href="mailto:test.security@oet.com.au">test.security@oet.com.au</a> putting &lsquo;allegation&rsquo; in the subject line or fill out the&nbsp;<a href="https://www.occupationalenglishtest.org/reporting-suspected-fraud-or-suspicious-activity/">Reporting Suspected Fraud or Suspicious Activity Form</a>.&nbsp;When making the report you have the&nbsp;option to remain anonymous.

10.3&nbsp;Malpractice Management&nbsp;
All candidate malpractice incidents are taken seriously and investigated.
Following a candidate malpractice incident, OET senior staff member will gather information and evidence pertaining to the malpractice incident and arrange a OET Malpractice Committee meeting who investigate all evidence and statements, and determines the outcome of the malpractice incident.
If you have been involved in any forms of malpractice prior to, during, or post taking a test, OET reserves the right to:
<ul>
<li>arrange for the malpractice incident to be investigated by the OET Malpractice Committee;</li>
<li>withhold your OET results pending the outcome of the investigation;</li>
<li>suspend you from taking/retaking OET based on the outcome of the investigation</li>
<li>request a statement or further information from you; and</li>
<li>apply penalties such as disqualifying your OET results (permanently withhold your results), instigate a banning period, and cancel any future booked OET if it falls within a banning period.</li>
</ul>
The OET Malpractice Committee will communicate the outcome of all malpractice incidents to candidates via a formal malpractice outcome letter that will be received by the candidate via written correspondence (i.e. email).
10.4&nbsp;OET Malpractice Committee&nbsp;
Candidate malpractice incidents are managed by the OET Malpractice Committee (the Committee) which are responsible for:
<ul>
<li>Implementing robust measures and controls for the identification and evaluation of allegations of malpractice.</li>
<li>Monitoring the effectiveness of internal controls to address suspected irregular conduct or malpractice.</li>
<li>Investigating findings for each malpractice allegation and decisions in relation to each allegation.</li>
</ul>
These decisions will include whether results will be published, as well as to determine whether any other penalties or remediation are imposed where appropriate.
OET reserves the right to withhold all suspicious candidates results where&nbsp;there is&nbsp;extensive&nbsp;evidence&nbsp;between two or more candidates&nbsp;sitting&nbsp;in&nbsp;close proximity&nbsp;at the same test venue&nbsp;and&nbsp;have&nbsp;a&nbsp;similar&nbsp;subtest(s)&nbsp;pattern&nbsp;of&nbsp;responses.&nbsp;&nbsp;
Where required, the Committee may determine there is sufficient evidence to impose a banning period. The outcome of this determination will be communicated.

10.5&nbsp;Malpractice Outcomes&nbsp;
Possible outcomes of the OET Malpractice Committee review include:
<ul>
<li>a candidate&rsquo;s OET results being disqualified (permanently withheld) in accordance with OET Test Regulations and&nbsp;<a href="https://oet.com/terms-conditions">OET Terms and Conditions</a>;</li>
<li>a candidate&rsquo;s OET results being released;</li>
<li>decision to impose a ban on the candidate from taking OET for a period of up to two years in accordance with the OET Banning Policy (below).</li>
<li>A candidate&rsquo;s upcoming OET test to be cancelled, and a refund may not be issued</li>
</ul>
In some cases, it may be deemed necessary to initiate legal proceedings where criminal conduct is suspected and/or communicate the outcome of the malpractice incident to Recognising Organisations.

10. Malpractice

If we determine, in good faith, that there is reasonable cause to suspect or conclude that you may have been involved in malpractice, or conduct that potentially compromises the results of the sub-test(s), OET may in its absolute discretion withhold or decide not to release your OET results.
If a candidate is suspected of engaging in any form of malpractice, or involved in activity that might damage the integrity and security of OET, candidates may not receive a test result, their test fee may not be refunded, and they may be banned from taking OET in the future.
If a candidate is banned, they will receive a written notification.
If the candidate books OET while a ban is in place, they will not receive a test result and may not be entitled to a refund.
If a result is issued to a candidate whilst the candidate is subject to a ban, the result will be cancelled and the candidate may not be entitled to a refund.&nbsp; Any Recognising Organisation that has accessed (or has access to) the results published will also be notified.

11. OET Banning Policy

OET welcomes feedback from our candidates. Where a complaint regarding our service is received, OET undertakes to address that complaint effectively and efficiently. OET takes a responsive approach to complaint management.

12.1&nbsp;Complaints Process&nbsp;
Please follow this process if you wish to complain about any test day issues or relating to an OET product or service. Please refer to the&nbsp;<a href="https://oet.com/remarking-policy">OET Re-marking Policy</a>&nbsp;if you wish to have sub-test results re-marked.

12.2&nbsp;There are two types of complaints:&nbsp;
12.2.1 Complaints regarding test day
If you are not satisfied with the way a test was administered or the venue staff&rsquo;s actions, you must lodge a complaint within 3 calendar days of the test being conducted using the&nbsp;<a href="https://oet.formstack.com/forms/complaints">OET Complaints Form</a>. If you do not make your request within that time frame, we reserve the right to refuse to investigate your complaint.
12.2.2 General Complaints
General complaints regarding OET products or services include:
<ul>
<li>test administration other than test day delivery issues (see 12.2.1 above for complaints regarding test day);</li>
<li>our service, including the application of our standard processes;</li>
<li>test results other than result appeals (please refer to the&nbsp;<a href="https://oet.com/remarking-policy">OET Re-marking Policy</a>&nbsp;for issues related to results); or</li>
<li>any other area of concern.</li>
</ul>
General complaints must be submitted within 30 calendar days of the relevant incident. Your complaint must be submitted by completing the&nbsp;<a href="https://oet.formstack.com/forms/complaints">OET Complaints Form</a>. If you do not make the request within that time, we reserve the right to refuse to investigate your complaint.

12.3&nbsp;Making a complaint&nbsp;
Concerns or issues will be first raised with the relevant operational service to work with the Complainant to resolve the matters raised. The Team Leader or the Manager is responsible for the management of complaints made directly to OET.
A complaint must be lodged by completing the&nbsp;<a href="https://oet.formstack.com/forms/complaints">OET Complaints Form</a>&nbsp;and providing as much information as possible to assist us in processing your request.
OET is committed to acknowledging the complaint within 3 business days and will take all reasonable steps to complete the complaint review process within 30 days.
In the event that you are the subject of a malpractice incident and receive an outcome letter from the OET Malpractice Committee, you are not eligible to make a complaint, instead you must lodge a stage 1 Appeal. Refer to Section 13 OET Appeals Policy and Process of these test regulations for more information. 
&nbsp;
12.4&nbsp;Management of the complaint&nbsp;

Upon receipt of your complaint, our investigation will include, as appropriate, obtaining additional information from you, statements from other candidates, and third parties as required, including but not limited to the Venue Manager and other Venue staff. As part of further investigations, we may review seating plans, details of candidate identity verification, or any additional information as required.
You will be advised of the outcome of your complaint within an appropriate timeframe.

12.5&nbsp;Complaint&nbsp;outcomes&nbsp;
Possible outcomes of complaints may include:
<ul>
<li>Results processed and published &ndash; your results may be processed following standard OET assessment processes.&nbsp;Note:&nbsp;OET is NOT able to increase marks in consideration of any issue affecting candidate performance.</li>
<li>Resit arranged &ndash; you may be offered a free resit if your complaint is upheld. The free resit offered may be for a single or all four sub-tests; this is at the discretion of OET.</li>
<li>Reversal of decision &ndash; the outcome will be reviewed, assessed and released after further investigation.</li>
<li>OET continuous improvement &ndash; complaints will be reviewed and used to improve OET processes and test delivery.</li>
</ul>

12.6&nbsp;How to lodge an Appeal
Any appeal against your complaint outcome must be lodged within 5 calendar days and will follow the procedure set out below in&nbsp;Section 13. OET Appeals Policy and Process&nbsp;of the Test Regulations.

12. OET Complaints Policy and Process

The OET Appeals Policy aims to ensure that candidates and OET Partners are able to appeal decisions made in relation to the OET Re-marking and Complaints policies, and that such appeals are received, reviewed and resolved in a fair and transparent manner.
The term &lsquo;Appellant&rsquo;, as used throughout this Policy, refers to OET candidates and OET Partners, including agents, preparation centres, test venues or Recognising Organisations, that lodge an appeal with OET.

13.1&nbsp;Appeals Process&nbsp;
The OET appeals process is an escalation point for Appellants who have undergone the OET Malpractice process, Re-marking Process, or the OET Complaints Process focusing on whether, in the course of reaching decisions relating to the Malpractice Policy, Re-marking Policy or Complaints Policy, OET applied its procedures properly and fairly in arriving at decisions by:
<ul>
<li>implementing, where relevant, sufficient investigation of material facts including, for example, invigilator and interlocutor conduct, malpractice, venue staff behaviour, the specific delivery and administration of OET; and/or</li>
<li>appointing qualified assessors who were not involved in the original marking to re-mark a candidate&rsquo;s sub-test; and/or</li>
<li>ensuring the assessor(s) carried out the relevant assessment process in accordance with the marking criteria; and</li>
<li>ensuring communication with the Appellant in a timely manner.</li>
</ul>
For re-marking appeals, the appeals process is not concerned with judgments about candidates&rsquo; work in the test. An appeal will not involve re-marking or re-assessment of a candidate&rsquo;s work, although this might be ordered as the result of an appeal if it is found that procedures have not been followed satisfactorily.
Where the outcome of an appeal brings into question the accuracy of grades awarded in an assessment, OET will take all reasonable steps to identify any other candidate who may have been affected and wherever possible correct or mitigate the error.
Where the outcome of an appeal results in the discovery of a failure in one of our processes or systems, the relevant Appeals Committee (Malpractice, Re-marking or Complaints) will review the relevant Process or system and take all reasonable steps to prevent re-occurrence.
OET has a two-stage appeal process:
<ul>
<li>Stage 1&nbsp;&ndash; this is the when the Appellant appeals the decision and outcome from either the OET Malpractice Process, Re-marking Process or Complaints Process</li>
<li>Stage 2&nbsp;&ndash; this is when the Appellant appeals the Stage 1 appeal decision and outcome from the relevant OET Appeals Committee</li>
</ul>

<li>A fee of AU$120 (OET on paper) / US$95 (OET on Computer) is payable for the submission of each stage of a Malpractice appeal: Stage 1 and Stage 2.</li>
<ul>
<li>This fee covers the administrative costs related to processing the appeal request.</li>
<li>Appeal fees will be refunded in full if the Appeal is upheld.</li>
</ul>
<li>Appeal Requests will only be accepted from candidates personally via the&nbsp;<a href="https://oet.formstack.com/forms/appeal_request_form">OET Appeal Request Form</a>. Requests made by a relative, friend or colleague will not be accepted.</li>
<li>Appeal requests must be submitted within 5 calendar days from the date of receiving the Malpractice outcome.</li>
</ul>
13.2.2 Re-marking Appeals
<ul>
<li>A fee of AU$120 is payable for the submission of each stage of a re-marking appeal: Stage 1 and Stage 2.</li>
</ul>

<li>This fee covers the administrative costs related to processing the appeal request.</li>
<li>Appeal fees will be refunded in full if the Appeal is upheld.</li>

<li>Re-marking charges will be refunded in full if the sub-test grade(s) change because of the Appeal.</li>
<li>Appeal Requests will only be accepted from candidates personally via the&nbsp;<a href="https://oet.formstack.com/forms/appeal_request_form">OET Appeal Request Form</a>. Requests made by a relative, friend or colleague will not be accepted.</li>
<li>Appeal requests must be submitted within 5 calendar days from the date of receiving the re-marking outcome.</li>

13.2.3 Complaint Appeals

<li>A fee of AU$120 is payable for each stage of a complaint appeal: Stage 1 and Stage 2.</li>

Note:&nbsp;If you take another test (OET or from any other provider) during the appeal, re-marking or complaint processes, OET will not refund any costs incurred in taking the additional test.

13.3&nbsp;Appeal Management&nbsp;
13.3.1 Stage 1 Appeal
<ul>
<li>The written evidence relating to your case will be considered by either the OET Remarking Appeals Committee, OET Complaints Appeals Committee or the OET Malpractice Appeals Committee.</li>
<li>All OET Appeals Committees will have an independent member, who is not involved in the administration or marking of OET.</li>
<li>The Appeals Committee will review all the written evidence relating to your case, to review and decide whether OET has applied its procedures properly and fairly in reaching its decision.</li>
<li>It is the role of the OET Appeals Committee to consider whether any further work relating to the original decision should be authorised (e.g. re-marking of additional scripts, gathering of additional evidence). If further work relating to the original decision is authorised, this information will form part of the OET Appeals Committee final recommendation.</li>
<li>The OET Appeals Committee includes the CEO (or their delegate) of OET and at least one member who is not a member of the OET Board, or an OET employee or assessor. The OET Appeals Committee will make a decision based on the findings, and any further information obtained during the appeal case review.</li>
<li>You will be notified in writing of the Stage 1 Appeal decision, including the outcome of any further work authorized, within:</li>
</ul>

<li>Malpractice Appeal: three weeks of your submission</li>
<li>Complaints Appeal: three weeks of your submission.</li>
<li>Remarking Appeal:&nbsp;eight weeks of your submission.</li>

13.3.2 Stage 2 Appeal
<ul>
<li>If you remain dissatisfied after receiving the decision of the OET Appeals Committee at Stage 1 you may request a Stage 2 appeal.</li>
<li>Upon request by you, your submission will be forwarded to an Independent Reviewer who considers appeals against OET Appeals Committee decisions. An Independent Reviewer is a suitably qualified external consultant with relevant experience.</li>
<li>You will be notified in writing of the Independent Reviewer&rsquo;s decision within:
<ul>
<li>Malpractice Appeal: three weeks of your submission</li>
<li>Complaints Appeal: three weeks of your submission.</li>
<li>Remarking Appeal: six weeks of your submission</li>
</ul>
</li>
</ul>
<ul>
<li>Consideration of an appeal by the Independent Reviewer concludes the OET appeals procedure.</li>
</ul>
How to lodge a Stage 2 Appeal
You must clearly explain in writing the reason for requesting the Independent Review by completing the&nbsp;<a href="https://oet.formstack.com/forms/appeal_request_form">OET Appeal Request Form</a>, within 5 days from the date of receiving the decision of the OET Appeals Committee, with AU$120 or US$95 (OET on Computer) payment in accordance with the payment instructions.

13.4&nbsp;Appeal&nbsp;Outcomes&nbsp;

<li>Results processed and published &ndash; your results may be processed following standard OET assessment processes. Note that OET is NOT able to increase marks in consideration of any issue affecting candidate performance.</li>
<li>Resit arranged &ndash; you may be offered a free resit if your Appeal is upheld.</li>

<li>Report from investigation &ndash; you will receive a report by email outlining the investigation and decision made by the Chair of the Appeal Committees.</li>
<li>OET continuous improvement &ndash; information regarding appeals will be provided to OET teams and used to improve OET processes.</li>
</ol>

Any breach of the OET copyright will be punishable by law and regulatory authorities will be notified.

OET respects the privacy of OET&nbsp;candidates&nbsp;and recognises the importance of protecting the information that you provide to us.
